BUILDING OF THE YEAR CREATED WITH ALUPROF SYSTEMS 2016 - 2018

§1 General Provisions

1.The Organizer of the "Building of the Year Created With Aluprof Systems 2016 - 2018" competition, hereinafter referred to as the Competition, is the company ALUPROF SPÓŁKA AKCYJNA (hereinafter referred to as "Aluprof").
2. The competition principles are set out in these Rules (hereinafter the "Rules").
3. The duration of the competition is from 03. 04. 2018 r. to 30.06.2018 r.
4. The aim of the competition is to select the most appealing architectural buildings constructed with the use of Aluprof aluminium systems, and to promote contemporary architecture, to create a forum where it will be presented, and the latest projects and architectural implementations discussed.  
5. The competition is open to general public and applies to buildings constructed using Aluprof systems between 1 January 2016 and 30 June 2018. A condition of submitting a building to the competition is that the building facade must be completed (although finishing-off works may still be ongoing inside the building).

§2 Taking part

1. The competition is for architects whose buildings created with Aluprof systems were constructed between 1 January 2016 and 30 June 2018, and whose applications -- and the submitted building -- satisfy the conditions set out in the Rules
2. Members of the Jury cannot take part in the competition.
3. Designing a building and submitting an application as indicated in section 1 are conditions which those taking part in the competition must satisfy. 
4. Application must be by a completed form as indicated in section 7.
5. Applications may be submitted up to 01.07.2018.
6. The application should be sent using the online form or by post. The competed form should be sent within the deadline for submitting applications i.e. up to 01.07.2018. Acceptance of the application will be confirmed after it is checked, by informing the applicant by separate e-mail.
7. The application must be completed in accordance with the instructions which you will find at  www.aluprof.eu or konkurs.aluprof.eu i.e. the exact data of the architect of the building (name and address/company name, legal form, address telephone, email address),  of the person submitting the building (name and address/company name, legal form, address telephone, email address) and data for the building ( name of building, developer’s name, contractor’s name, address of the building  and the Aluprof systems used) must be provided, and also photographic documentation of the building being submitted must be attached. A photograph of a clearly visible general view of the building is required. Photos submitted as photographic documentation should be of a minimum size of 2400 x 1600 pixels. 
8. The submitted application should contain a declaration by the author(s) of the building being submitted, for the use of the project for the competition purposes and their consent to process their personal data i.e. name and address of designer of the project or the architect's studio, name of contractor, developer's name and the photos of the building submitted, for the purposes and to the extent required in the competition.
9. In submitting the application to the competition, the applicant consents to have his materials submitted, to be published in the public media. The relevant declaration will be made on the application form, or sent through the post.
10. Third parties may submit a building to the competition, who is/are not the author(s) of the building, and have the author's/authors’ authorization for this and the author’s consent to use the competition project for the purposes of the competition and for publication of materials submitted to the competition in the public media. Third parties submitting the application are under an obligation to submit to the Organizer a declaration by the architect(s), on behalf of whom they make the application for his/their participation in the competition, consenting to make declarations on his behalf in matters relating to the competition, including declarations as set out in section 8 and 9 and in § 5 section 1, 2 and 8 of the Rules. Applicants should attach the consent for processing their personal data and the author(s) /co-authors consent for their data to be processed i.e. name and surname of the author of the project or the architect's studio, contractor’s name, developer’s name and the photos of the building submitted, for the purposes and in the extent required in the competition.
11. The applicant must provide the details of all authors/co-authors of the building being submitted. The application submitted is deemed to be the applicant’s declaration in respect of the above. The provisions of section10 are applied as appropriate. 
13. Aluprof shall not be liable to third parties for the content of an application submitted by the applicant on their behalf.


§3 Prizes

1. There are three prizes in the competition – one for each of the three persons selected, as set out in §4:
a) 1st prize – PLN 50 000.00,
b) 2nd prize – PLN 30 000.00,
c) 3rd prize – PLN 15 000.00.
2. The prizes will be paid out within 30 days from the date on which the competition results are announced, by bank transfer into the account indicated by the winners.
3. The prizes awarded in the competition may be subject to taxation on principles under the Personal Income Tax Act. If a natural person wins an award who does not conduct economic activity, Aluprof will deduct the appropriate tax and will issue the appropriate acknowledgement to the winner. If a natural person who conducts economic activity wins a prize, he/she must satisfy the tax obligations connected with receiving the award.
4. Architects of the 10 buildings nominated in the competition will be awarded with a diploma.


§ 4 The course of the competition

1. The selection of the competition work will be made by the Competition Jury, which will consist of architects, representatives of the trade press and people working in the architectural or construction industry. The full composition of the Jury can be seen on the website konkurs.aluprof.eu.The members of the jury shall give separate consent to the processing of their personal data, i.e. first and last name, degree, profession and a photo for the purpose and scope related to the competition, including publication on the website konkurs.aluprof.eu. 
2. After the expiry of the deadline for the receipt of applications, the Competition Organizer will prepare all the applications along with the accompanying documentation and select from them 50 works that qualify for the next stage. The deliberations of the Competition Jury will be held in August 2018. The results will be announced during the ceremonial gala in September 2018.
3. The competition will be divided into three stages:
a) in stage 1 the Competition Organizer will select 50 works from among the submitted entries that will qualify for the next stage, 
b) in stage 2 the Competition Jury will select 10 works from among the qualified works in stage 1, which will be qualified for stage 3,
c) in stage 3 the Competition Jury will select 3 works from among the qualified works in stage 2, in which each will receive one of the three prizes indicated in §3. 
4. All the authors of buildings, which buildings qualify to the 50 buildings selected by the Organizer, will take part in the ceremonial gala summarizing the competition, which will take place in September 2018. Invitations with the date and location of the Gala will be sent by Aluprof to the interested parties.
5. The results of stage 1 will be published on the website konkurs.aluprof.eu within 15 days of the closing date for the submission of entries. The results of stages 2 and 3 will be announced during the ceremonial Gala in September 2018.


§ 5 Plebiscite for the most appealing Building of the Year 2016 - 2018

1. In the period between 18.07.2018 to 01.09.2018 Internet users will have the opportunity to vote online on the website of the Internet Competition “Building of the Year Created With Aluprof Systems”, to select the most appealing building submitted to the competition.
2. Each site visitor may vote only once. Among voters whose selected building takes first place as the most interesting, Aluprof will draw 10 in-kind prizes. 
3. The architect whose building receives the largest number of votes will receive the title “Internet Users' Choice”.


§ 6 Final provisions

1. The winning buildings will be presented in industry and public media. The presentation may contain information about the Aluprof materials used, the name of the investor, the first and last name of the design's author, the name of the contractor. The applicant by submitting an application consents to this.
2. Aluprof acquires the right to use the buildings awarded and distinguished in the competition in the sphere of publishing and presenting them at exhibitions in Poland and abroad, for an indefinite period of time, respecting copyright. The applicant by submitting an application to the competition consents to the above.

4. The Rules enter into force on 3 April 2018. The content of the Rules is available at the headquarters of Aluprof or on the website konkurs.aluprof.eu.
6. Competition advertising materials are for information purposes only - only the provisions of these Rules are binding. 
7. Participation in the competition is tantamount to acceptance of these Rules.
8. A participant submitting an application to the competition agrees to:
a) the presentation of his/her competition work in accordance with paragraphs 1 and 2,
b) the processing of his/her personal data (first name, last name, profession, place of employment) for the purposes related to the competition.
9. Any disputes arising in the course of the duration of the competition and not provided for in these Rules shall be settled by the Organizer.
10. Each participant is entitled to lodge a complaint to the Organizer related to the competition mode, in writing within 7 days of its completion. 
11. The Organizer reserves the right to make changes in these Rules.
12. The Civil Code shall apply in matters not governed by these Rules.


§ 7 Protection of personal data

1. Data in the form of the first name, last name, company, email address, postal code, city, street and phone in the building competition application form will only be used for verification of the person’s participation in the design / implementation process of the proposed building and also: - to confirm the acceptance of the application for the competition - for contact in cases that information required to accept the application or for the proper presentation of the proposed building on the competition's website https://konkurs.aluprof.eu needs to be supplemented / clarified or to explain resulting inaccuracies in the information - to contact in other relevant matters relating to the participation of a given person's project in the competition.
2. Data in the form of the email address provided on the voting form will only be used for contact if the person voting is selected to receive an in-kind prize for participation in the voting as mentioned in the rules. The provision of personal data by the User is entirely voluntary, however, failure to provide will result in the inability to submit a completed application form or - in the case of Internet voting - the lack of the possibility to vote.
3. Personal data described in points 1 and 2 are processed on the basis of Article 6 paragraph 1 point f of the GDPR* (legitimate interests pursued by Aluprof S.A.) – the person to which the data applies can at any time lodge an objection – for reasons related to his/her specific situation – to the processing of his/her data based on this basis.

5. The provided data will only be disclosed to authorized employees of Aluprof S.A. and an outside service provider of the competition website administration. Data may also be disclosed to the competent authorities as long as they are authorized to do so in accordance with applicable law.
6. We inform that your personal data shall not be transferred to a third country/international organization and that it will not be processed in an automated manner within the meaning of art. 22 of the GDPR* nor will it be used for profiling.
7. Personal data will be processed for the duration of the competition and archived until the request of its removal, sent to the address konkurs@aluprof.eu. The data of building designers submitted to the competition located on the website https://konkurs.aluprof.eu next to the photos of the buildings will remain visible on this site also after the competition. The data of persons participating in the voting for Internet users will be removed after the drawing of the prizes provided for in the rules and after delivering the aforementioned prizes.
8. Information about the request to delete data together with data can be stored for a period of 3 years for evidence purposes, and after this period will be removed.
9. A person who provided her/her data in the voting form or in the building competition application form at any time has the right to request from Aluprof S.A. to access to his/her personal data, its rectification, deletion or limitation of processing and the right to object to the processing as well as the right to transfer the data and to obtain copies. To do this, please submit information with a request to the address konkurs@aluprof.eu.
10. A person who provided her/her data in the voting form or in the building competition application form also has the right to lodge a complaint to the supervisory authority - the President of the Office for the Protection of Personal Data.
